If you are watching the Rittenhouse trial and now the judge and lawyers are arguing the Jury Instructions, their wording and what happens when you put them all together. There is confusion on the current instructions saying or lack of saying that if the Defendant was protected by Self Defense the there is no need to go on to lesser charges because the lesser charges would be invalid because the Defendant acted under Self Defense.
I am reminded about a case I saw in the newspaper 25 years ago in California. A woman was sunbathing nude in her backyard concealed by a wooden privacy fence. A neighbor 15 year old boy discovered a knothole in the fence, his mother discovered him. She had the nude arrested for Indecent Exposure.
Rather than pay the fine she took it to trial. Her attorney had the the law read out loud which said ”revealing one’s reproduction organs.” Then her doctor testified that a woman’s reproductive organs are inside her body and then shielded by hair. My initial thought was “That’s just like lawyers, always trying to split hairs!”
